What I can sue if ….? (Situation in details)?

The main thing I want to know is if you can still take this to small claims court small where the maximum is to sue for $ 5000. Someone touched my ass 4 times (swiped my card buttcrack with Micros Mangement Systems) and commented sex to me twice. Then when I confronted this person about it, pulled a knife on me. I did a police report on time, but did file with the Commission on Equal oppurtunity. They want to close the file because it did not have enough information about witnesses. That's bad you want to close the file in my case that is confidential information that the company I used to work for would not voluntarily provide. ¿I can sue the EEOC to delay me like this?
